1. Acceptance of Terms

By downloading, installing, or using Resalent ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is developed and operated by Vasily Ponomarev ("I", "me", "my").

2. Description of Service

Resalent is a habit-building iOS application that analyzes biometric data (sleep, HRV, heart rate), calendar, and weather to find optimal moments — "resonance points" — for your habits. The App provides personalized timing suggestions, not medical advice.

3. Not Medical Advice

Resalent is not a medical device and does not provide medical advice. The resonance scores, pattern insights, and timing suggestions are for informational and wellness purposes only. They should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice because of information provided by the App.

4. Eligibility

The App is available to users of all ages (rated 4+). By using the App, you represent that you have the legal capacity to enter into these Terms, or that a parent or guardian has agreed on your behalf.

5. User Responsibilities

You are responsible for:

• Ensuring your device meets the minimum requirements (iOS 17 or later)
• Granting or revoking permissions (HealthKit, Calendar, Location, Notifications) as you see fit
• Using the App in compliance with all applicable laws
• Maintaining the security of your device

6. Subscriptions and Payments

6.1 Free Tier

Resalent offers a free tier that includes up to 3 habits, basic resonance scoring, and weekly progress view.

6.2 Premium Subscription

Premium features (unlimited habits, pattern detection, historical insights) are available through auto-renewable subscriptions. Subscription options:

• Monthly: $9.99/month
• Semi-annual: $6.99/month (billed as $41.94 every 6 months)
• Annual: $4.99/month (billed as $59.88 per year)

6.3 Payment and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings

6.4 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple. I do not process refunds directly. Visit reportaproblem.apple.com to request a refund.

7. Intellectual Property

The App, including its design, code, algorithms, graphics, animations, and content, is owned by Vasily Ponomarev and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the App.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. All personal data is stored locally on your device. No personal data is transmitted to external servers.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

I do not warrant that:

• The App will be uninterrupted or error-free
• The resonance scores or timing suggestions will be accurate or beneficial
• The App will be compatible with all devices or OS versions

10. Limitation of Liability

To the maximum extent permitted by applicable law, Vasily Ponomarev shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or emotional distress, arising out of or in connection with your use of the App.

In no event shall the total liability exceed the amount you paid for the App in the 12 months preceding the claim.

11. Third-Party Services

The App integrates with Apple HealthKit, Apple Calendar, and weather data services. These services are governed by their own terms and privacy policies. I am not responsible for the availability, accuracy, or functionality of third-party services.

12. Modifications to the App and Terms

I reserve the right to modify, suspend, or discontinue the App or any feature at any time without prior notice. I may also update these Terms from time to time. Changes will be reflected on this page with an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

You may stop using the App at any time by deleting it from your device. I reserve the right to terminate or suspend access to the App if you violate these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia. Any disputes arising from these Terms or the use of the App shall be resolved through good-faith negotiation or, if necessary, through the courts of the Republic of Serbia.
